AI Services – Terms of Use

Integration with the General Terms: This section supplements, and with respect to AI Services prevails over, the General Terms and Conditions of Ovation Srl (“Ovation”). For all matters not governed here, the General Terms apply.


1. Purpose and Scope

This section governs the use of any artificial intelligence-based functionality made available on dynamic.ooo or other sites belonging to Ovation and advised through the documentation, within Ovation’s Applications, or through cloud-based services provided by Ovation (the “AI Services”), including, by way of example, conversational assistants, AI-powered tools for WordPress environment interaction (such as plugin and theme management, site configuration, and related capabilities), tools that provide explanations, suggestions, examples, configurations and code relating to Ovation’s products and services, curated documentation retrieval, as well as future related services.

The AI Services do not replace official documentation, technical support, or professional advice.


2. Availability, Previews, Modifications and Plans

2.1 Modes and labels. AI Services may be offered with different labels (e.g. “Preview”, “Experimental/Labs”, “General Availability/GA”, “Early Access”, “Limited Release”) and through different plans (e.g. Free, Pro, Business, Enterprise). These labels are informational only and do not imply warranties, SLAs or additional rights.

2.2 Service levels and maintenance. Unless expressly stated for a specific plan, no SLAs or uptime guarantees are provided. Maintenance (scheduled or urgent) may cause interruptions or degraded performance.

2.3 Evolution of the service. We may introduce, modify or remove features, usage limits, integrations or AI models; update parameters and security; and adjust AI Services to meet legal or quality requirements. For material changes or degradation in subscription services we will provide reasonable notice, except in urgent situations, including but not limited to security or compliance cases.

2.4 Plans and fees. AI Services may be free of charges or paid for. We may introduce or modify plans and pricing in the future; details will be published on the site or in your account. The rules on pricing, invoicing and taxes from the General Terms apply.

2.5 Suspension and termination. We may suspend or terminate AI Services, in whole or in part, including but not limited to for technical, security, compliance or business reasons. Where reasonably possible we will give notice; in urgent cases involving e.g. security, integrity or third-party rights, suspension may be immediate. The General Terms provisions on suspension/termination remain applicable.

2.6 Capacity management and dynamic limitations. In the absence of published limits, AI Services will be provided on a best effort basis. To protect quality, security and continuity, we may dynamically apply proportional measures (e.g. rate-limiting, throttling, concurrency limits, request queuing/prioritization, prompt or attachment size limits, filtering, temporary blocking). These may vary depending on load, usage profile or risk of abuse. If the intervention is not urgent and not security/compliance-related, we will provide reasonable notice (e.g. in-app message or email) and, if appropriate, offer a path to a suitable plan.


3. Proper Use and Limitations (Fair Use)

3.1 Permitted use. You may use AI Services to obtain informal assistance with Ovation’s products and services: explanations, suggestions, examples, configurations and code snippets that you must review and test before use. Where AI Services include tools that interact with your WordPress environment (such as managing plugins, themes, or site settings on your behalf), use is permitted exclusively within the scope of features you have subscribed to and through the authorized interfaces provided by Ovation.

3.2 Prohibited use. You may not:

    1. circumvent or attempt to circumvent technical safeguards or dynamic limitations;
    1. automate high-volume requests without authorization;
    1. resell or offer AI Services as a standalone service (SaaS, proxying), unless under a written agreement;
    1. use multiple accounts or share credentials in order to evade limits or anti-abuse controls;
    1. submit unlawful, harmful or discriminatory content;
    1. include credentials, secrets, or personal/sensitive data;
    1. systematically extract, download, scrape, or otherwise reproduce the contents of the Curated Documentation (as defined in Section 13) through automated means or any other method, regardless of the stated purpose.

3.3 Fair use and abnormal use. Abnormal use includes (by way of example): sustained or burst traffic that may even potentially negatively affect quality for other users; unauthorized mass automation; usage patterns incompatible with service purposes (e.g. systematic scraping of the model); continued usage despite notices or applied limits. In such cases we may apply the measures in Section 2.6, including but not limited to suspension.

3.4 Proportionality. Except in urgent security/compliance cases, we will endeavor to act with proportionality and good faith: (i) applying the minimum necessary measures; (ii) informing you of the undertaken actions and reasons; (iii) where possible, offering a remediation path (adjustments or plan change).

3.5 No guarantee. The absence of published limits does not guarantee unlimited resources or ability to process any workload, services are provided on a best effort basis.


4. Accuracy, Human Review and Responsibility

Output may be incomplete, inaccurate or outdated. It is the burden of the User to review, test and validate before using them in production. The warranty exclusions and liability limitations from the General Terms apply fully to AI Services.

With respect to output based on Curated Documentation: such documentation is derived from third-party sources (including, by way of example, documentation relating to WordPress plugins, themes and platforms, and content subject to Open Source licenses including GPL-family licenses), which may not be up to date and may not accurately reflect the current version of the relevant third-party product. The Curated Documentation is maintained exclusively for internal AI processing purposes. Output derived from Curated Documentation is provided to Users as part of AI Services, but carries no warranty as to accuracy, completeness, or fitness for purpose. Ovation’s curation activities (selection, annotation, enrichment) do not constitute an endorsement of the underlying third-party content.


5. Intellectual Property in Prompts and Output

5.1 Your content. You retain rights which you are otherwise entitled to in your prompts, attachments and output. Under such rights the User grants Ovation a non-exclusive, worldwide, limited license to use such content to provide AI Services, for security, anti-abuse, model training, RAG and similar usage, and diagnostics, and—as set out in Section 7.4—for service improvement.

5.2 Third-party code or content. Output may include references to third-party code or content subject to their own licenses (e.g. GPL, MIT). It is your responsibility to verify suitability and comply with those licenses.

5.3 Restrictions. You may not remove license notices, watermarks or attribution in outputs.

5.4 Curated Documentation.

(a) Ovation’s contributions. The original selection, structure, annotation and enrichment of documentation carried out by Ovation in creating the Curated Documentation constitutes intellectual property of Ovation. All rights in such contributions are reserved, except as otherwise provided in these Terms.

(b) Third-party content. The underlying third-party content included in the Curated Documentation remains subject to its respective original license. This includes, without limitation, content subject to Open Source licenses (including GPL v2 or later, or similar copyleft or permissive licenses) provided by third-party plugin or platform vendors. Ovation processes such content server-side only, for the exclusive purpose of enabling AI Services functionality. No distribution of GPL-licensed or similarly licensed content to end users occurs. Users receive only AI-generated outputs, which do not constitute distribution of the underlying documentation.

(c) User restrictions. You may not extract, copy, reproduce, store, or redistribute the Curated Documentation, in whole or in part, outside the scope of your permitted use of AI Services. Output generated by the AI from Curated Documentation may be used by you for your ordinary business purposes; however, where such outputs include substantial verbatim reproductions of third-party content, you are responsible for verifying and complying with the applicable license of such third-party content.


6. Code Safety Guidelines

Do not paste generated code directly into production without review; avoid execution with elevated privileges; do not include API keys, passwords, credentials, or personal/third-party data in prompts. Output is provided for educational purposes only.


7. Privacy and Data Protection (GDPR)

7.1 Roles.

  • Self-service on the site: Ovation acts as controller for conversation logs and metadata required for service delivery and security.
  • On-site AI tools (e.g., tools that interact with the User’s WordPress installation on the User’s behalf): Ovation provides the AI tools and infrastructure but does not access, process, nor store the content of the User’s WordPress site. The User remains the sole controller of all personal data and other data hosted on their site. Ovation acts as controller only with respect to service metadata, logs, and performance data generated in connection with the operation of the AI tools. For the documentation retrieval component of AI Services, Ovation processes only the queries submitted to the system; no data from the User’s site is accessed or processed by Ovation in connection with documentation retrieval.
  • Enterprise/API offering: upon agreement and Data Processing Agreement (DPA), Ovation may act as processor on behalf of the customer. Please contact us to negotiate this if you are interested in this use.

7.2 Data categories and minimization.

Where AI Services are accessed directly by Users (e.g. on dynamic.ooo): do not submit your own or other people’s personal data in prompts or queries. If you do, it will be processed only to the minimum extent necessary for service delivery and security.

Where AI Services are accessed via Ovation’s plugins or applications by third-party AI agents: queries are generated autonomously by AI systems configured by the User. The User is responsible for ensuring that their AI systems do not include personal data or sensitive information in queries sent to Ovation. Ovation cannot control or predict the content of automatically generated queries.

In both cases, Ovation deliberately does not process special categories (Art. 9 GDPR) and it is expressly prohibited to process them. Where personal data is nonetheless included in a query, it will be processed only to the minimum extent necessary for service delivery and security, including by anonymising or pseudonymizing them when practical.

7.3 Retention. Conversation logs are retained for up to 30 days by default, unless longer retention is required for security or legal purposes. For enterprise customers, retention can be customized via DPA.

7.4 Improvement and human review (opt-in).

  • Default: conversations may be processed only automatically for security, anti-abuse and aggregate/anonymous metrics.
  • With your explicit and revocable consent, our team may selectively access extracts of conversations to improve models, answer quality and documentation. We apply minimization, pseudonymization/anonymization where possible, controlled access, and max 30-day retention for such extracts, unless required otherwise by law. You can withdraw consent at any time via the interface.

7.5 AI providers and third-party services. We may use one or more AI model/service providers and other third-party technical suppliers, varying over time. All such providers process data within the EEA. We disclose categories of recipients in our Privacy Policy.

7.6 Security. Appropriate technical and organizational measures: encryption in transit, access controls, logging and audit, logical segregation, periodic testing.

7.7 Transparency and rights. We clearly indicate when you are interacting with an AI system and provide the information required by applicable law (GDPR/EU AI Act). You can exercise privacy rights under our Privacy Policy.

7.8 Privacy contact. For inquiries or to exercise rights: privacy@dynamic.ooo (or such other contact as indicated).

7.9 Minors. AI Services are not intended for individuals under 18.


8. Transparency and Regulatory Compliance (EU AI Act)

Ovation follows applicable transparency measures for systems interacting with natural persons (e.g. chatbots) and aligns with the EU AI ActArticle 50 requires informing users when they are interacting with AI and labeling synthetic content (deepfakes; certain public-interest text). Key application dates are set in the Act’s final provisions. It is prohibited to use the AI Services for activities which are prohibited by the AI Act, even if the User is or thinks they are not subject to the AI Act.


9. Support and Limitations

Support for AI Services is provided on a best effort basis and may differ from standard support. We may refuse or discontinue conversations that violate these Terms or the General Terms.


10. Fees and Plans

AI Services may be free, trial, or paid. Plans and prices, including any usage limits, are published on the site or in the account and may be updated over time, with reasonable notice of material changes to subscription services. The pricing, invoicing and tax rules of the General Terms apply.


11. Suspension/Termination for Violation or Abuse

In cases of substantial legal breaches, violation of these Terms, abnormal use, or risks to security/third parties, we reserve the right to apply the same measures as described in Section 2.6 also for such violations, including suspension or closure of access to AI Services.


12. Governing Law and Jurisdiction

The law and jurisdiction specified in the General Terms apply (subject to mandatory consumer protections, where applicable).


13. Definitions

  • “Prompt”: text and attachments submitted to the AI Services.
  • “Output”: responses generated by AI.
  • “AI Provider”: third party providing AI models/services used in AI Services.
  • “Curated Documentation”: the collection of technical documentation maintained by Ovation on its servers for the exclusive purpose of enabling AI Services functionality, comprising: (i) original content authored by Ovation; (ii) third-party documentation (including, by way of example, documentation relating to WordPress, plugins, themes and platforms provided by third-party vendors) that has been selected, processed, annotated and/or enriched by Ovation; and (iii) content derived from sources subject to Open Source licenses (including GPL v2 or later or similar). The Curated Documentation is not directly accessible to Users; it is consumed solely by AI agents as part of AI Services delivery.
